Patent offices are not a fixture in most people’s daily lives. Aside from those working in a corporate IP department, the chance of meeting a patent attorney is extremely rare. For comparison, if you choose a doctor or a hospital, there are often review sites that offer reliable information. However, virtually no reliable review information exists for patent offices or patent attorneys. This is precisely why we must perform our work with an unclouded conscience and the highest ethical standards.

A few years ago, I met with the head of a venture company who told me, “I was advised by a patent firm to file 10 separate applications.” When I reviewed the contents, I was shocked to find that they had simply varied the application of the invention to create 10 distinct filings. In reality, a single application would have been sufficient.

In my experience, protecting a new business has never immediately required ten patent applications. Patent filing represents a cost. Cost reduction is a mandate for any company, and achieving necessary and sufficient results within a limited budget is a responsibility owed to shareholders. Drawing on my experience of launching several venture businesses myself, I have always pursued the goal of achieving the objective with the minimum number of patent applications. That experience forms the core guiding principle of our firm’s practice.

The same principle applies to large corporations and SMEs with their own IP departments. If a client has a budget for five filings, our role is not just to extract five themes from the inventor’s proposals. Instead, we must identify the more fundamental technology that the inventor may have overlooked and prompt them to reconsider. We then secure rights for that strengthened invention within the allotted budget. Five such applications are often equivalent to the original 20 or 30.

How much added value can we bring to the table? That should be the mission and the joy of those working in intellectual property. It is often a subtle, unseen effort, but it is the essence of this profession.
